ICC Trial Chamber recommends Ruto, Sang trials be held in Kenya.Leaves Uhuru to suffer..

The International Criminal Court (ICC) Trial Chamber recommends to the court’s presidency to hold start of Ruto, Sang’s trial in Kenya or alternatively Tanzania.



Trial Chamber V(A) recommends to the Presidency that it may be desirable to hold the commencement of trial and other portions thereof, to be determined at a later stage, in Kenya or, alternatively, in Tanzania.


This recommendation is made following a request by the Defence of 24 January 2013 and after obtaining observations from the parties and participants, as well as the relevant authorities.


This recommendation made by Trial Chamber V(A) is only a step in the procedure – set out in Rule 100 of the Rules of Procedures and Evidence – as the final decision on the issue will be made in due course by the judges, in plenary session. 



While the seat of the Court is in The Hague (Netherlands), where the Court considers that it would be in the interests of justice, it may decide to sit in a State other than the Netherlands.


Earlier, the ICC had set the opening of the trial in the case against Deputy President William Samoei Ruto and Joshua Arap Sang on September 10, in order to allow the defence sufficient time to carry out its preparation.
