Mr Stephen Muriuki was charged before the Nairobi chief magistrate where he denied posting an offensive message to Mr Mwau.
The prosecution said that on May 12 at 11.52am through facebook, Mr Muriuki posted a “grossly offensive” message which caused annoyance and created anxiety to Mr Mwau.
“You drug lord…God will punish you for what you did, do you think if you are rich you can kill people, you killed Saitoti and Ojode and four innocent lives…may you rot in hell,” the message, read in court said.
Mr Muriuki is accused of violating the communication laws through the use of a licenced medium.
He was granted a cash bail of Sh30,000 and the case set to be heard on June 17. A mention will be on June 3.
Mr Mwau is listed as the first state witness alongside two police officers. The suspect was not represented.
Prof George Saitoti, who was the Internal Security minister and his deputy, Orwa Ojode were killed in a helicopter crash on June 6, 2012 at Kibiku forest in Ngong, Kajiado County.
Two pilots, Captain Nancy Gitunja and Captain Luke Oyugi also perished alongside the ministers’ bodyguards.
A presidential appointed commission led by Justice Kaplana Rawal investigated the incident and reported that the possible cause of the crash was the pilot losing control of the aircraft in bad weather.
The commission failed to identify the exact cause of the crash citing major lapses in the autopsies.- Daily Nation
